What happens if you stay in country where your visa has expired?

  • I am from Brazil, and went to Spain as a student. I ended up meeting many friends, and I stayed longer than I was supposed to..

    My visa has expired. What can I do now? What happens if I go home? Would I be able to come back? Can I make a new visa? Can I do it in Spain?


  • what you have done i think is illegal and the authority's could have a warrant out for you, don't worry about it go to the local police station and explain.





  • If you try to just go home, they'll find out at the airport that you have overstayed. You'll be banned from entry to all 26 Schengen states.

    Go to your embassy or to the spanish immigration office. There may be a chance to change your status from student to visitor, since on your Brazilian passport you could travel visa-free as tourist for 90 days.

    But do that in advance of your departure, or you will risk an entry deny in most of the European states.
