What are the laws regarding Import Tax/Duty/Clearance Fee/Customs when importing to the US?

  • Bought a couple things from hong kong (i live in the US)

and ive read that they sometimes charge a fee/tax/something to items..

Total cost for these items are under $5..

I've done a bit of research and it appears that if the item is valued under $200, you don't have to pay anything.

Is that just if they check "Gift"?
What happens if they check "Merchandise?"

    Thanks!

  • If you pay for the item, they CAN'T mark it gift.
If you are not a retailer ordering samples, they CAN'T mark it sample merchandise.

Tell them to do the forms legally. Other and the amount you paid (but not shipping) and to include the invoice.

Marking items "gifts" is a quick way to have customs open the package and assign their own value to the item.
